Policies


 

Policy Concerning Non-Members

The article of incorporation and the by-laws of the Association state that the purpose and function of the Association is exclusively for the members of the Association. The by-laws (Article II§2) also state, Except in connection with the sale or transfer of a lot, no member shall transfer his/her membership or any rights of membership. In accordance with the by-laws and articles of incorporation, and in consideration of the best interests of members in good standing, the following state the policy of the Board of Directors for uniformly handling matters related to non-members (i.e. renters or guests) residing in or visiting the Pla-Vada community.

  1. In matters concerning Association business, communications from the Board shall be directed to the member. Non-members may request copies of communications for informational purposes, which will be provided at the expense of the non-member.

  2. Non-members may attend annual membership or Board of Director meetings for informational purposes. Non-members have no right under the governing documents to vote or to address the Association; however, the presiding president of the Board of Directors may allow a non-member the opportunity to address the Association when deemed appropriate in the president's reasonable discretion.

  3. Non-members have no right under the governing documents to participate in Association business.

  4. Pursuant to the governing documents, membership rights, including the right to vote, may not be transferred; however, a member may grant another person the power to vote on behalf of such member by written proxy, as authorized by the governing documents and the California Corporations Code.

  5. Fines imposed for violation of the governing documents by non-members shall be levied against member/owner on whose property a non-member is residing or visiting.

  6. It is the responsibility of members to inform non-members of the Association's CC&R's, rules and policies based on the governing documents.
